These Terms of Service ("Terms") are a legally binding agreement between you and XEENO, a US-based technology brand registered at 3300 N Triumph Blvd #G40 Lehi, UT 84043, USA ("XEENO", "we", "us", "our") governing your use of xeeno.store and related services (collectively, the "Services"). By accessing or purchasing from our website, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our Services.

1. Acceptance of Terms; License

By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Return & Refund Policy.

Our Services are intended for individuals 18 years of age or older. If you are under 18, you may only use our Services with the involvement of a parent or legal guardian.

Subject to your compliance with these Terms, XEENO grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use our website for personal shopping purposes only.

2. Modifications to Terms

XEENO reserves the right to update or modify these Terms at any time at our sole discretion. We will make reasonable efforts to provide at least 7 days notice before any material changes take effect via email or a notice on our website. Your continued use of our Services after changes constitutes your acceptance of the updated Terms. The latest version will always be available at the bottom of our website.

3. Your Information

As part of the account creation and checkout process, you will be required to provide accurate personal and payment information. You are responsible for maintaining the accuracy of your information.

By submitting any reviews, comments, ideas, or feedback to XEENO, you grant us the right to use such content without compensation to improve our Services and marketing.

4. Restrictions and Responsibilities

You agree not to, directly or indirectly:

- Use our Services for any commercial service bureau or for the benefit of any third party
- Export our Services in violation of US laws and regulations

You are responsible for maintaining the security of your account, password, and devices. You may not share your account credentials. You are responsible for all activity under your account.

You may not:

- Transfer your account to a third party
- Post links to unauthorized third-party sites using our brand
- Use our Services for spamming, scamming, or any illegal purpose
- Upload content that depicts violence, nudity, or is unlawful, discriminatory, threatening, defamatory, or infringes intellectual property rights

5. Account, Orders and Billing

You may review and modify your account, orders, and billing information at any time in the "My Account" section.

Order Processing: When you place an order on XEENO, you are entering into a binding contract to purchase that product. It is your responsibility to review the product listing, price, and shipping details before placing an order. Typographical errors in orders are your responsibility.

Pricing: XEENO reserves the right to modify product prices at any time without notice to correct pricing errors or due to supplier cost changes.

Product Information: All product descriptions, specifications, and images are provided by our verified US suppliers. While we strive for accuracy, XEENO does not warrant that all information is error-free. It is your responsibility to verify product suitability before purchase.

Order Changes and Cancellations: Once an order is placed, it generally cannot be modified or cancelled. However, if you contact our US-based support team at xeeno.support@gmail.com as soon as possible, we will make reasonable efforts to accommodate your request. We are not liable for losses from approved or denied cancellation requests.

Payments, Transaction Fees and Sales Tax: All payments are processed via credit/debit card, PayPal, Payoneer Checkout or other methods shown at checkout. A small transaction fee may be applied by our payment processor and will be shown at checkout. This fee is non-refundable unless your order is cancelled by XEENO.

Sales tax will be collected on orders shipped to certain US states as required by law. The exact tax amount will be displayed at checkout and will be refunded if your order refund is approved.

6. Shipping and Handling

All XEENO orders are eligible for shipment only within the 50 United States. We do not accept P.O. Box, APO, or FPO addresses.

XEENO offers FREE standard US shipping on all orders. We ship from our US warehouse network powered by Doba AI for fast domestic fulfillment. Estimated delivery is 2-7 business days for contiguous US and 3-8 days for Alaska and Hawaii.

You are responsible for shipping costs if you return an item, even if you refuse delivery. Oversized items may require custom shipping calculation requiring your approval before shipping. Published shipping weights are for informational purposes only.

XEENO is not responsible for product defects, shipping errors, or transit damage caused by carriers, but we will assist you per our Return & Refund Policy.

7. Product Warranty

XEENO products are provided "AS IS". Any warranties are provided by the product manufacturer, not XEENO. All warranty claims should be submitted directly to the manufacturer. For consumer electronics, please refer to the warranty card included with your product.

8. Intellectual Property

XEENO owns all rights, title, and interest in and to our website, brand, logos, designs, content, and technology. No ownership is transferred to you under these Terms.

You may not reproduce, repackage, or resell any XEENO content without prior written consent. Product images and descriptions may be used for personal reference only. Bulk downloading or "screen scraping" of our website is strictly prohibited and will result in immediate account termination and potential legal action.

9. Term and Termination

These Terms remain in effect while you use our Services. You may terminate your account at any time. XEENO reserves the right to terminate or suspend your account at any time for any or no reason.

XEENO may terminate your account immediately if you: materially breach these Terms and fail to cure within 7 business days, engage in fraudulent or illegal activity, or harm other customers or XEENO's interests.

All provisions that by their nature should survive termination will survive, including payment obligations, confidentiality, warranty disclaimers, and limitation of liability.

10. Warranty Disclaimer

XEENO will use commercially reasonable efforts to keep our Services operational with minimal errors. Our Services may be temporarily unavailable for maintenance.

HOWEVER, XEENO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED "AS IS" AND XEENO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnity

You agree to indemnify and hold harmless XEENO, its directors, officers, employees, and representatives from any third-party claims arising from your use of our Services or your violation of these Terms, including any damages, lost profits, judgments, and attorney fees.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE XEENO WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, WORKMANLIKE EFFORT, LACK OF VIRUSES, OR LACK OF NEGLIGENCE.

13. Limitation of Liability

EXCEPT FOR BODILY INJURY, XEENO AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR (A) ERROR OR INTERRUPTION OF USE, LOSS OF DATA, OR LOSS OF BUSINESS; (B) ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES; (C) ANY MATTER BEYOND XEENO'S REASONABLE CONTROL; OR (D) AMOUNTS EXCEEDING THE TOTAL FEES PAID BY YOU TO XEENO IN THE 12 MONTHS PRIOR TO THE CLAIM, WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Miscellaneous

Relationship: You are an independent customer of XEENO. No agency, partnership, joint venture, or employment is created by these Terms.

Confidentiality: You agree not to share confidential information received from XEENO with any competing business. Violations will result in immediate termination.

Governing Law; Venue: These Terms shall be governed by the laws of the State of Utah, without regard to conflict of law principles. Any legal action arising from these Terms shall be filed exclusively in the federal or state courts located in Salt Lake City, Utah. You submit to the personal jurisdiction and venue of such courts. YOU IRREVOCABLY WAIVE THE RIGHT TO TRIAL BY JURY AND AGREE THAT CLAIMS MAY ONLY BE BROUGHT ON AN INDIVIDUAL BASIS, NOT AS PART OF A CLASS ACTION.

Entire Agreement: These Terms constitute the entire agreement between you and XEENO regarding our Services.

Please note, return shipments sent directly to our corporate office without an approved return label will be refused and ineligible for refund. Always follow the return process in your account.
